Tuna at Subway etc..

Question

I was wondering whether one should take into account that some of these establishment are cited for many food violations. If that is the case, can we still assume that the utensils are clean when it comes to preapring the tuna?

In case you weren't aware, Jewish stores are also cited for food violations. We still have the Halcha that says a person would not jeopordize his business. CYA
