Chumrot

Question

Has ve-shalom that R. David Weiss Halivni would say such a thing! However, Louis Ginzberg might have said such a thing. He was of the opinion (and I hope I have this right...no one should be misquoted) that the Talmud does not record any real decisions, but is rather a record of opinions. So the decisions of the Shulhan Arukh might in many cases be considered chumrot without a true basis (of previous pesak) in Shas.
