More on Yashan

Dear Aaron, When you say that all of yashan is a sfeik sfeika, if you are not m'tzaref the opinion that chodosh is permitted in chutza laaretz, then you must be basing yourself on the sfeik sfeika mentioned by the Rama: it is a safeik if the grain is from this year and, even if it is, it is a safek whether the grain took root before pesach. However, the main point of my question still stands: the fact that the vast majority of bread flour in the US is chodosh after a certain date is machria any sefeikot. Since you choose not to use the info available on yashan, you should abstain from consuming all bread (cookies and cake would be OK because there is a genuine sfeik sfeika without a definite rov.) However, there is a difficulty with the Rama's sfeik sfeika anyway because it violates one of the sfeik sfeika principles: it is misheim echad. In other words, the sfeikot he notes are only superficially different, in reality they both amount to saying it is a safek whether the grain is yashan or chadash. (This is because the safek about whether the grain is from this year's harvest or not, in and of itself, has no halakhic implication without the further assumption about the time it took root.) The only valid sfeik sfeika would be: it is a safek if this is yashan or chadash, and even if it is chadash, there is a safek whether chadash is prohibited in chutza laaretz. The latter safek is very questionable. In the end, we should just follow Maran Habeit Yosef, who did not accept any of this reasoning!
